RELEASE OF LIABILITY

In exchange for user’s (“Beta User”) participation in using SZ DJI TECHNOLOGY CO., LTD together with its affiliates (“DJI”) BETA SDK and for using BETA SDK products, Beta User agrees to the following:

BETA USER ACKNOWLEDGES THAT FOR THE BETA SDK AND FOR THE BETA SDK PRODUCTS, DJI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY NATURE WHATSOEVER WITH RESPECT TO ANY PRODUCT FURNISHED BY DJI TO THE USER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PROJECT OR AGAINST INFRINGEMENT. ALL PRODUCTS OFFERED IN THE BETA VERSION OF DJI’S SDK ARE PROVIDED “AS-IS” AND “WITH ALL FAULTS”. DJI SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM THE USE OF THE BETA SDK AND THE USE OF THE BETA SDK PRODUCTS WHATSOEVER. DJI DOES NOT MAKE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO THE NON-INFRINGEMENT OF THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS OR TRADE SECRETS WITH RESPECT TO THE BETA SDK PRODUCTS OR THE BETA SDK.

Beta User acknowledges that even if there are issues with the Beta SDK and the Beta SDK products, and the SDK or the products malfunction or crashes; DJI will not offer any warranty coverage whatsoever.

Beta User agrees to discharge DJI from liabilities arising from any of the Beta SDK and the Beta SDK products in accordance with the release of claims section below.

Release of Claims

I, Beta User, hereby agree that: I release and discharge DJI, and its officers, employees, shareholders, officers, directors, insurance carriers, parents, or affiliates and agents, from and against any claims, demands, causes of action, obligations, damages, liabilities, costs or fees which arise from or are related to the use of DJI’s Beta SDK, DJI’S Beta SDK Products, and their related activities.
